Apex makes payment toward fees owed

STEUBENVILLE - Apex Sanitary Landfill made a "substantial" payment last week toward the roughly $394,000 it owes for unpaid tipping fees, and indicated the balance would be forthcoming this week, JB Green Team Chairman Bob Chapman said this morning.

"We had indicated we would seek collection of the delinquency through legal channels," Chapman said. "They stepped up, made a payment" and asked us to work with them.

"We feel it's in the best interests of everyone to stop the legal procedures and try to clean it up in a diplomatic way. We'll know at the end of this week, beginning of next week (if that's possible). If they don't fulfill their obligation, the board meets in December and we'll probably decide then" how to proceed.

At its last meeting, the JB Green Team had voted to ask the Jefferson County prosecutor to pursue possible criminal charges against the landfill as well as a civil lawsuit claiming breach of contract.

The Jefferson County Board of Health also issued notice of violation to Apex for non-payment of tipping fees to the health department.

"They not only had not been paying us, they had not been paying the health department," Chapman said. "We're making a good faith effort to try and clean (this) up before we have to litigate it."
