WHEELING - A lawsuit that claimed Ohio Valley Health Services & Education Corp., the parent company of Ohio Valley Medical Center and East Ohio Regional Hospital, breached the contract of its former chief executive officer has been settled.
David Jividen, attorney for Brian Felici, former CEO of the hospital corporation, said a settlement was reached about six months ago.
"The hospital asked for a confidentiality agreement. We're pleased with the outcome,'' Jividen said. "The counterclaim they filed against him was dismissed.''
Jividen said he could not disclose dollar amounts related to the settlement. But in the original complaint filed in Ohio County Circuit Court, Felici claimed the corporation breached its contract by not paying him after he resigned April 7, 2009, as CEO. The corporation, he claimed, agreed to pay him $303,000 a year for a three-year contract - Oct. 1, 2009 to Oct. 1, 2012 - plus bonus compensation of up to $100,000 for each year of the contract.
Jividen said the hospital paid Felici in installments with the last payment being made in January. And because the hospital's counterclaim was dismissed, Felici did not have to pay the hospital anything, he noted.
"You can see that Brian prevailed,'' Jividen said.
In his original complaint, Felici noted after the hospitals' board of trustees hired American Healthcare Solutions he was informed he would be replaced as CEO. AHS was hired to shore up the hospitals' finances at that time.
"This was settled to the satisfaction of all parties. We have no further comment,'' said hospital spokeswoman Laurie Labishak.
Felici now is the CEO at Wetzel County Hospital.
