Thirty-eight indicted by Brooke County grand jury
WELLSBURG — A Wellsburg man accused of threatening an off-duty police officer and a woman who wrecked into the Brooke County sheriff’s vehicle were among 38 indictments handed down by a Brooke County grand jury on Monday.
Thomas Wetterau, 27, of 177 Megan Drive East, Wellsburg, was indicted for wanton endangerment involving a firearm, harassment and violation of another’s civil rights for allegedly threatening an off-duty police officer outside a Weirton business on July 10.
According to police reports, Wetterau told the officer, “I hope you get popped” and lifted his shirt, revealing a handgun.
Police said Wetterau’s actions were captured by a video camera at the business.
He also was indicted on two counts of child neglect creating risk of injury because his two children were with him in a shopping cart when the incident occurred.
The case was investigated by the Brooke County Sheriff’s Department.
Tess L. Haynes, 27, of 48 Payton Drive, Weirton, was indicted for driving under the influence with serious bodily injury.
West Virginia State Police reported the vehicle Haynes was operating struck the vehicle of Brooke County Sheriff Rich Beatty on Aug. 9, causing him to sustain a fracture to the spine, while he was parked along U.S. Route 22 and responding to a disabled tractor-trailer between the Main Street and Harmon Creek exits.
They said a used hypodermic needle was found in Haynes’ deployed airbag.
Jeffrey E. Mitchell Sr., 53, of Wellsburg was indicted on three counts of sexual abuse by a person entrusted to a child, two counts of second-degree sexual assault and one count each of first-degree sexual abuse and use of a minor to produce obscene matter.
According to the indictment, the charges stem from alleged intercourse and inappropriate sexual contact with a minor and sexually explicit photos he’s said to have induced the minor to take.
Derek J. Fisher, 32, of Colliers was indicted on one count of burglary and three counts of first-degree sexual abuse for alleged sexual contact with a minor between 2018 and 2022.
Zebulan J. Lawrence, 23, of 93 Palomino Drive, Weirton, was indicted for malicious assault for allegedly intentionally striking another with his vehicle, causing bodily injury to him, on July 28.
Michael Ensminger, 46, of 58 27th St., Wellsburg was indicted for driving while his license was revoked for driving under the influence, fleeing with reckless disregard, fleeing on foot, resisting arrest and carrying a concealed deadly weapon. The charges stem from a June 28 incident in which police pursued Ensminger on Main Street and Gilbert Avenue, Follansbee, allegedly traveling at a high rate of speed, veering into the opposing lane and passing through two stop signs.
Ensminger also was indicted for burglary, for allegedly entering a Wellsburg home with intent to commit a crime, on Dec. 29; grand larceny for allegedly stealing a car on May 18, 2021; and two counts of failure to appear.

— Sydney M. Ball, 21, 130 Hudson Ave., Weirton, embezzlement for allegedly stealing more than $1,000 in scratch-off lottery tickets her former workplace.
— Phillip Bennington, 40, Apartment 2, 3104 West St., Weirton, breaking and entering, conspiring to do so and grand larceny for allegedly stealing more than $1,000 in items, including an all-terrain vehicle, from a storage unit.
— Samantha Sinsel, 35, 156 Weirview St., Weirton, was indicted for grand larceny and conspiring for the same theft as Bennington and for forging and uttering a check on another’s account and delivering a controlled substance.
— Channlear S. Burek, 29, 446 Buffalo Road, Wellsburg, breaking and entering and grand larceny for the alleged theft of a dirt bike and fraudulent use of a debit card.
— Joshua Charlton, 43, 83 Park Addition, Wellsburg, for six counts of failure to register as a sex offender.
— Amber N. Colvin, 30, 162 Patterson Road, Weirton, delivering a controlled substance.
— Aaron Cottrill, 32, 1106 Neville St., Follansbee, illegal entry of a building other than a dwelling, conspiring to do so, petit larceny, obstructing an officer and fleeing.
— Brandi N. DiEdwards, 34, 202 Basil Drive, Weirton, delivering a controlled substance.
— Billy L. Erskine, 25, 224 Hudson Ave., Weirton, possession of a controlled substance with intent to deliver.
— Frank Galiano, 65, 605 Main St., Follansbee, failure to register as a sex offender.
— Dustin W. Geary, 29, 471 Rockdale Road, Follansbee, third-offense domestic violence.
— Joseph C. Goff, 41, 100 Jordan St., Weirton, burglary and third-offense shoplifting.
