Woman pleads guilty to child’s death

Other pleas heard in Brooke County

WELLSBURG — A woman charged with child neglect resulting in the death of her child was among four who entered guilty pleas in Brooke County Circuit Court on Friday.

Both Rachel Camilletti, 36, and Zachary Henderson, 36, of Follansbee, were indicted for child neglect resulting in death after their toddler died from ingesting fentanyl in their home on Aug. 3, 2022.

Brooke County Prosecuting Attorney Joseph Barki told the court a medical examiner found a large quantity of the drug in the child, “enough to kill a large horse.”

Camilletti used a tissue to dab her eyes as she appeared before 1st Judicial Circuit Court Judge Ronald Wilson on Friday.

Wilson noted under state law, the penalty for the crime is three to 15 years in jail, a fine of $1,000 to $5,000 or both. He is slated to rule on Aug. 27.

Camilletti’s plea comes following a plea agreement reached by Barki and her attorney, Sean Norman. It calls for two other charges of gross neglect resulting in substantial risk of injury or death to be dropped.

The same charges were filed against Henderson, who is slated to return to court on June 17.

Camilletti told the judge she has been undergoing treatment for substance abuse and her last positive drug test was more than one year and three months ago.

Norman confirmed he plans to introduce testimony regarding Camiletti’s character at the sentencing hearing.

Also appearing on Friday was Daniel Walden, 39, of Bethany, who pleaded guilty to driving under the influence resulting in serious bodily injury and leaving the scene of an accident with vehicle damage.

Also scheduled for sentencing on Aug. 27, Walden faces two to 10 years in jail and a fine of $1,000 to $3,000 for the first charge and up to six months in jail or a fine of $100 to $500 for the second charge.

Barki told the court on April 24, 2022, Walden sideswiped a vehicle in the Bethany area, then drove away, and while traveling state Route 67, swerved into the opposing lane, striking another vehicle.

He told the court the other driver was transported by medical helicopter for multiple injuries and ultimately lost a leg because of the accident.

Barki said the woman supported the plea agreement reached by him and Walden’s attorney, Robert McCoid.

A plea of guilty also was entered by Jason Sandy, 42, of New Cumberland, to the charge of driving while license revoked for driving under the influence.

Sandy was sentenced to one to three years in jail and ordered to pay a $3,000 fine following his incarceration.

Assistant Brooke County Prosecutor John Kyle told the court on July 7, Sandy’s vehicle veered from Main Street, Follansbee, through three yards before crashing into the front porch of a home.

Kyle said the owner of the home supported the plea agreement reached by him and public defender Thomas Kroger.

Also on Friday, Reginald Johnson, 48, of Steubenville, pleaded guilty to malicious assault in connection with a May 28 domestic dispute during which Johnson threw a glass in the direction of a woman known to him.

Kyle said the woman raised her hand to deflect it and was cut by it.

Through a plea agreement reached by Kyle and Kroger, Johnson will serve one year of supervised probation.

During that time, he must comply with various conditions, including counseling, and pending his compliance, will return to plead guilty to the lesser charge of domestic battery, for which he will be fined $100.

Wilson said the court is to be advised promptly if any incidents occur in that time while noting if Johnson fails to successfully complete probation, he will face the penalties for malicious assault.

Under state law, those convicted of malicious assault face two to 20 years in jail.

Kyle said the plea agreement was supported by the victim of the crime.
