WEIRTON - Weirton Council will consider, during its meeting tonight, whether to declare a residential property in the city a nuisance.
Convening at 7 p.m. in the Council Chambers of the Weirton Municipal Building, councilmembers will be asked to consider a resolution to declare the property at 1201 Hanlin Way "to be a Public Nuisance and Authorizing Abatement of Said Nuisance." The resolution has been sponsored by Mayor Dean Harris and City Manager Mike Adams.
Council held a public hearing prior to its regular August meeting to receive testimony on the property, with several members of the community in attendance.
According to the resolution, "the residential property known as 1201 Hanlin Way, Weirton, WV 26062, owned by Megan E. Swain/Mozingo generated so many complaints and/or property maintenance violations since August 2022 that it represents a Public Nuisance as defined by City Ordinance 511.03."
The resolution notes the property has been at the attention of the city since 2024, when legal counsel for the owner agreed to a plan of action "to rectify existing issues." A new citation was issued in May, "confirming that multiple property maintenance violations existed/persisted." A criminal complaint also was filed in May, with a summons to appear for the cited violations, with an additional citation issued in July.
Officials have noted attempts to contact the owner concerning the property have been unsuccessful, with the city taking measures to remediate some of the concerns through pest baiting, garbage removal, and other efforts.
If the resolution is approved, it will authorize the city manager "to take all steps necessary to abate existing hazards at said location, up to and including demolition or in any other lawful manner deemed appropriate," in city code, as well as the filing of liens through the respective county.
