Brooke County grand jury issues indictments for 23

WELLSBURG – The Brooke County grand jury on Monday indicted 23, including four charged with sexual offenses.

Presided by Circuit Court Judge Ronald Wilson, the grand jury returned indictments against the following:

— Zachary A. Allen, 27, of 72 North Ave., Wellsburg, on a charge of incest and three counts each of third-degree sexual assault and sexual abuse by a custodian for actions alleged to have occurred in February and March.

— Brent M. Pellen, 21, of 110 Forest Drive, Wellsburg, on four counts of third-degree sexual assault for alleged sexual contact with a youth less than 16 years old in April.

— Christopher McCoy, 39, of 5 Park Ave., Beech Bottom, for first-degree sexual abuse and second-degree sexual assault for alleged sexual contact with a woman without her consent.

— Logan S. Daugherty, 25, of 764 Virginia Ave., Follansbee, for second-degree sexual assault and first-degree sexual abuse for alleged sexual contact with a woman without her consent.

— Patrick E. Hauck, 33, of RD 1, Wellsburg, on a charge of malicious assault in which he allegedly used a knife to cut a man who was attempting to break up an altercation between him and another man.

— Derek J. Fisher, 25, of 506 Pennsylvania Ave., Colliers, for malicious assault on an officer and obstructing an officer. According to the indictment, Brooke County sheriff’s deputies were conducting a welfare check on Fisher, who was believed to have injured himself.

When Fisher reached for a dagger, a struggle followed, causing Fisher to cut the deputy’s hand.

Brooke County Prosecutor Joseph Barki III said the deputy didn’t sustain long-term injury from the wound.

— John M. McGowan, 38, of 117 Skyline Drive, Follansbee, for three counts of wanton endangerment for allegedly pointing a 12-gauge shotgun at three people outside a Follansbee bar on Dec. 18.

According to police reports, a woman attempted to take the gun from McGowan, causing it to fire, but no one was harmed.

— Joseph Benjamin Ware III, 41, of 107 Ingram Ave., Weirton, for child abuse creating a substantial risk of injury and delivery of crack cocaine. Weirton Police said Ware attempted to trick a teen into smoking the drug by telling her it was marijuana,

— William Paul Hunter Jr. 23, of 57 Doman St., Wellsburg, for burglary, fleeing on foot from an officer and possession of a stolen vehicle.

— Brittany Ann Gibson, 26, of 528 Highland Ave., Follansbee, for grand larceny for allegedly stealing two shotguns and re-selling them.

— Jonathan Ray Beatty, 27, of 2517 Charles St., Wellsburg, for forging and uttering a check on another’s account.

— Christopher Lee Winters, 37, of 800 Main St., Wellsburg, for obtaining money under false pretenses by allegedly taking $5,250 for repairs to a local woman’s roof.

— Chad E. Griffith, 44, of Rear 332 Commerce St., Wellsburg, for third-offense driving under the influence and driving while his license was revoked for DUI.

— Alec L. Armstrong, 21, of 55 24th St., Wellsburg, for driving under the influence and fleeing while DUI.

— Dustin W. Geary, 22, of 317 Latimer Ave., Follansbee, for felonious destruction of property.

— James Albert Stevens III, 28, of 111 Woodcrest Road, Follansbee, for burglary and petit larceny.

— David Shawn Kearns, 43, of 3955 Eldersville Road, Follansbee, driving under the influence and fleeing while DUI.

— Jeremy L. Gagich, 33, of 153 Briar Lane, Wellsburg, for burglary and grand larceny.

— Antoinette Marie Kidd, 24, of 2103 Pennsylvania Ave., Weirton, forgery of a public record and obstructing for allegedly signing a traffic citation with a false name.

— Wesley P. Cross, no age or address given, for transporting a constrolled substance into the state and three counts each of delivering heroin and conspiring.

— Brandon R. Brown, no age or address given, for delivering heroin, delivering it within 1,000 feet of a school and two counts each of conspiring.

— Desirhea J. Mayes, no age or address given, for two counts of conspiring to commit a crime, specifically, delivering heroin.

— Ashlei N. Berdine, 22, no address given, for delivering a controlled substance and conspiring.
